- Introduction
Welcome to ALALAYAN Immigration Services (“we,” “us,” or “our”), a Philippines-based provider of general immigration information and consulting services focused on assisting Filipinos with pathways to Canada. These Terms of Service (“Terms”) govern your access to and use of our website (the “Site”) and related services (collectively, the “Services”). By accessing or using the Site or Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or Services.
- Important Disclaimers – No Legal or Immigration Advice
All information on the Site, including chatbot responses, articles, guides, or any other content, is provided for general informational purposes only. It does not constitute legal advice, regulated immigration advice, or the creation of any adviser-client or attorney-client relationship.
Under Canadian law (Immigration and Refugee Protection Act, Section 91), only authorized representatives—such as members in good standing of the College of Immigration and Citizenship Consultants (CICC/College-IC), Canadian lawyers, or notaries—may provide paid immigration advice or representation for applications to Immigration, Refugees and Citizenship Canada (IRCC). Unauthorized representation or advice is illegal and may result in your application being refused or returned.
Our website content and chatbot are not regulated immigration advice and should not be relied upon for decisions about your immigration status. We do not guarantee any visa, permanent residence, or other outcome—immigration decisions are at the sole discretion of IRCC and depend on your individual circumstances, current laws, and government policies, which can change.
For personalized assistance, you must enter into a separate written client agreement with us (or our authorized representatives, if applicable). Always verify any representative’s credentials directly with the College-IC public register or the appropriate Canadian law society. If we are not acting as an authorized representative in your specific matter, we strongly recommend consulting a licensed professional.
We do not provide services or advice in any jurisdiction where we are not authorized. Outcomes are never guaranteed.
- Acceptance of Terms
By using the Site or Services, you confirm that you have read, understood, and agree to these Terms (including updates). We may revise these Terms at any time. Continued use after changes constitutes acceptance. Material changes will be notified on the Site or by email where feasible.
- User Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to form a binding contract. By using the Site or Services, you represent and warrant that you meet this requirement.
- Description of Services
The Services provide general information and resources on Canadian immigration pathways for Filipinos. Any paid consulting or representation services will be governed by a separate client agreement detailing scope, fees, responsibilities, and additional disclaimers.
- Chatbot and Automated Tools
Any chatbot or AI tool on the Site offers only general, non-personalized information. It does not provide regulated advice, create a client relationship, or substitute for consultation with a qualified authorized representative. Do not rely on it for immigration decisions.
- User Accounts and Conduct
If you create an account or submit information, you must provide accurate, current, and complete details and keep them updated. You are responsible for your account credentials.
You agree to use the Site and Services only for lawful purposes and not to:
- Upload harmful code, viruses, or disruptive material;
- Attempt unauthorized access;
- Infringe intellectual property or privacy rights;
- Harass, defame, or interfere with others; or
- Use the Site for unauthorized commercial purposes.
We may monitor or remove content that violates these Terms.
- Intellectual Property
All Site content (text, graphics, logos, images, software, etc.) is owned by us or our licensors and protected by Philippine and international copyright, trademark, and other laws. Limited personal, non-commercial viewing is allowed. No copying, reproduction, modification, or distribution without our express written permission.
- Third-Party Links
Links to third-party sites are for convenience only. We do not endorse, control, or accept responsibility for their content, privacy practices, or availability. Use them at your own risk.
- Fees, Payments, and Refunds
Fees for any paid services are set out in a separate client agreement. Refunds (if any) follow that agreement. No refunds for general Site use.
- Termination
We may terminate or suspend your access at any time, with or without notice, for any reason (including violation of these Terms). Surviving provisions (disclaimers, liability limits, governing law) remain in effect.
- Indemnification
You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities, and expenses arising from your use of the Site/Services, violation of these Terms, or infringement of others’ rights.
- Disclaimer of Warranties
The Site and Services are provided “as is” and “as available” without warranties of any kind (express or implied), including accuracy, reliability, or fitness for purpose. We do not warrant uninterrupted, error-free, or secure operation, nor any immigration outcome.
- Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of opportunities or immigration status) arising from your use of the Site or Services. Our total liability shall not exceed the amount you paid us (if any) in the 12 months before the claim.
- Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes shall be subject to the exclusive jurisdiction of the appropriate courts in the Philippines. We comply with applicable Philippine laws (including the Data Privacy Act of 2012), Canadian immigration regulations where relevant, and other laws in jurisdictions where we operate or users reside.
- Severability and Entire Agreement
Invalid provisions do not affect the remainder. These Terms constitute the entire agreement regarding the Site and Services.
